Frequently asked questions
- What value is the transfer tax calculated on?
- Since Ley 11/2021 the taxable base is the Catastro reference value whenever it exceeds the price stated in the deed. The Constitutional Court upheld this unanimously in its ruling 13/2026 of 12 February. If the reference value is lower, the declared price applies.
- Why does the same flat pay such different tax depending on the region?
- Transfer tax is devolved to the autonomous communities, which set their own rate and their own reliefs. On top of that, the Basque Country and Navarra have foral regimes, and Ceuta and Melilla apply the State rates with a 50% rebate on the quota.
- Do all regions apply a single rate?
- No. Some apply a single rate, others a progressive scale where each band pays its own rate, and others a banded tariff where the band reached sets the rate for the whole value. That difference changes the final figure.
- What if two of us buy and only one meets the requirements?
- Andalucía, Cantabria, Canarias and La Rioja state that the reduced rate applies only to the share of whoever qualifies. Castilla y León does the opposite: it requires every buyer to meet the age condition.
- Do I pay transfer tax on a new build?
- No. A new build is taxed at 10% VAT plus the stamp duty set by the region, IGIC in Canarias and IPSI in Ceuta and Melilla.
The tax is the predictable part
The expensive surprises are elsewhere: registry charges, outstanding debts or square metres that do not match the Catastro. Our AI reviews the property and explains it to you.
